24CV011019-590Under and by virtue of a judgment of the Superior Court of Mecklenburg County, North Carolina, in that certain civil action entitled:"Mecklenburg County vs. Prosperity Church Road, LLC"the undersigned Commissioner will on Monday, May 13, 2024, at 2:00 P.M., at the usual place of sale at the Civil Court House of Mecklenburg County, Charlotte, North Carolina, offer for sale to the highest bidder for cash:
All that certain lot or parcel of land, situate, lying and being in Mecklenburg County, North Carolina, and more particularly described and defined as follows:
Tract I: Being all of the property labelled "COS 81,216 SQ. FT." as the same is shown on the map of PROSPERITY PLACE, Phase 1, Map 1 (PORTION), recorded in Map Book 39 at Page 787, Mecklenburg County Public Registry, which property is designated as tax code number 029-322-26.
Tract II: Being all of the property labelled "COS 9,232 sq. ft." as the same is shown on the map of PROSPERITY PLACE, Phase 2, Map 1, recorded in Map Book 40 at Page 903, Mecklenburg County Public Registry, which property is designated as tax code number 029-322-46.
Tract III: Being all of the property labelled "COS 1,447 sq. ft." as the same is shown on the map of PROSPERITY PLACE, Phase 2, Map 1, recorded in Map Book 40 at Page 903, Mecklenburg County Public Registry, which property is designated as tax code number 029-322-47.
Tract IV: Being all of the property labelled "COS 327 sq. ft." as the same is shown on the map of PROSPERITY PLACE, Phase 2, Map 1, recorded in Map Book 40 at Page 903, Mecklenburg County Public Registry, which property is designated as tax code number 029-322-48.
Tract V: Being all of the property labelled "COS 45,383 sq. ft." as the same is shown on the map of PROSPERITY PLACE, Phase 2, Map 1, recorded in Map Book 40 at Page 903, Mecklenburg County Public Registry, LESS AND EXCEPT that portion of said property removed from said designation by revised plat recorded in Map Book 45 at Page 403, the remaining property which is the subject of this tax suit being designated as tax code number 029-324-79.
Tracts I, II, III, IV and V BEING a portion of the same property conveyed to Prosperity Church Road, LLC, a North Carolina limited liability company, by Deed recorded in Book 12263 at Page 648 in said Registry.
The successful bidder of each sale will be required to deposit five percent (5%) of the bid price.
The bid will remain open for ten (10) days for increased bids.
The property will be sold subject to taxes for the year 2024, and all local improvement assessments against the property not included in the judgment in the above-entitled action.
The bid will be subject to confirmation by the Court.
